Section 106 Agreements
Under Section 106 of the Town and Country Planning Act 1990 Nuneaton and Bedworth Borough Council utilises Section 106 (S106) Agreements to mitigate negative impacts of development in the Borough.
S106 is a legally binding planning obligation in which a landowner or developer may agree to a range of specific commitments, in order to gain planning permission for a particular site. It sets out what the developer agrees to do, and the circumstances and timescales within which this will happen.
Planning obligations may only constitute a reason for the granting of planning permission if they are:
- Necessary to make the development acceptable in planning terms
- Directly related to the development
- Fairly and reasonably related in scale and kind to the development
Common obligations include financial contributions that help to improve or increase capacity of facilities and infrastructure in the local area.
